Court Ruling Casts Doubt on Legality of U.S. Reciprocal Tariffs
A major development in the U.S. trade landscape has introduced significant uncertainty for importers. On Tuesday, the U.S. Court of International Trade (CIT) issued a ruling that could upend several key tariff measures currently in place. According to the court, the President does not have the authority under the International Emergency Economic Powers Act (IEEPA) to unilaterally impose “reciprocal tariffs” including the 30% duty recently levied on Chinese imports without prior approval from Congress.
This ruling directly challenges the legal foundation for a broad range of tariffs enacted under the so-called “Liberation Day” measures. In response, the court has issued a permanent injunction blocking enforcement of these tariffs and has ordered the administration to implement the ruling within 10 calendar days. However, the U.S. government has already announced its intention to appeal the decision, which could prolong the uncertainty through a lengthy legal process.
The ruling has far-reaching implications for shippers and importers. If the injunction stands, it could effectively eliminate:
- The 30% reciprocal tariff on goods from China
- The 25% tariff on select goods from Mexico and Canada
- The 10% duty currently applied to imports from a wide range of countries
Important to note: The court’s decision does not impact tariffs on steel, aluminum, autos, or auto parts, as those were imposed under different statutory authorities (specifically Section 232 of the Trade Expansion Act).
